MONTGOMERY CREEK, Calif. — Detectives from the Shasta County Sheriff’s Major Crimes Unit who are continuing to investigate the Montgomery Creek shooting death of a man have released the victim’s name and say they are continuing to search for those responsible for the victim’s murder.
The murder investigation began late Monday evening, Sept. 28, after deputies from Shasta County Sheriff’s Burney Station heard gunshots while patrolling the area of SR-299E and Bakus Rd.
Deputies began searching the area and eventually found the victim’s lifeless body “with apparent gunshot wounds to the upper body”, in the Round Mountain area of Windy Point Rd., Shasta County Sheriff’s Major Crimes Unit Sgt. Kyle Wallace had previously reported.

Along with patrol deputies, detectives from the Shasta County Sheriff’s Major Crimes Unit who assumed the investigation located and interviewed several witnesses who reported hearing a verbal altercation prior to the gunshots, Wallace said in an earlier release.
The victim has since been identified as 34-year-old, Noel Garcia from Hayward, California. Officials have described Garcia as an out-of-compliance parolee and documented Campo Ramos Locos gang member, who had not notified his parole officer that he had left the Sacramento area.
Garcia was on active California Department of Corrections and Rehabilitation (CDCR) parole for attempted murder out of West Sacramento, according to Wallace; who added, “As part of Garcia’s parole conditions, he was required to notify his parole officer prior to leaving his county of residence.”
During their subsequent investigation, officials learned Garcia was part of an illicit marijuana growing operation in the Windy Point neighborhood where he was found deceased.
Detectives also learned Garcia recently arrived in the area to work on the illegal marijuana operation; which has since been eradicated, according to Wallace, who said the sheriff’s investigation is active and ongoing.

MONTGOMERY CREEK, Calif. — Authorities say a murder investigation is underway in the Round Mountain area of Shasta County after a deceased man was discovered in the area of Windy Point Rd. late Monday evening, Sept. 28.
Deputies who heard gunshots while patrolling the area of SR-299E and Bakus Rd. and began searching the area eventually found the victim’s lifeless body near the roadway, according to officials now investigating the homicide.

Deputies from Shasta County Sheriff’s Burney Patrol Station were on routine patrol around 10 p.m., when they heard several gunshots from the area of Windy Point Rd., about a quarter mile east of their location, Shasta County Sheriff’s Major Crimes Unit Sgt. Kyle Wallace has since said of the ongoing murder investigation.
After hearing the gunshots, deputies began searching the area, ultimately finding “an unidentified adult Hispanic male deceased near the roadway, with apparent gunshot wounds to the upper body,” explained Wallace.
The man was declared deceased at the scene.
The victim’s name has not been released, pending further investigation, positive identification and notification of the man’s family.
Detectives from the Shasta County Sheriff’s Major Crimes Unit were summoned and assumed the investigation.
“Witnesses in the area were contacted who overheard a verbal altercation prior to the gunshots,” said Wallace; adding, “This is an active and ongoing case.”
